Right of Withdrawal
The right of withdrawal varies depending on the type of product purchased.
For standard, non-personalized shoes, Customers purchasing as consumers may exercise the right of withdrawal within 14 days, without having to provide any reason, in accordance with Articles 52 et seq. of Italian Legislative Decree No. 206/2005 (Consumer Code).
For sandals made to measure or clearly personalized according to the Customer’s individual specifications, the exclusion from the right of withdrawal provided for by Article 59 of the Consumer Code applies.
In all cases, the consumer’s rights in relation to defective, non-conforming or incorrect products remain unaffected.
Right of Withdrawal for Shoes
For standard shoes that are not made to measure or clearly personalized, Customers purchasing as consumers have the right to withdraw from the purchase contract, without having to provide any reason, within 14 days from the day on which the Customer, or a third party appointed by the Customer other than the carrier, acquires physical possession of the products.
The right of withdrawal is available to consumers, meaning natural persons who make a purchase for purposes unrelated to their business, commercial, craft or professional activity.
Exclusion from the Right of Withdrawal for Sandals
All Sandali Corcione sandals are handcrafted and made to order according to the individual specifications selected or communicated by the Customer.
Each pair of sandals is therefore specifically made following the order, according to the characteristics requested by the Customer, such as, by way of example, size, model, colour, materials, height, applications, decorations or other available features.
Pursuant to Article 59 of Italian Legislative Decree No. 206/2005 (Consumer Code), the right of withdrawal is excluded, among the other cases provided for by law, for the supply of goods made to measure or clearly personalized.
Therefore, for sandals which, due to the individual specifications requested by the Customer, fall within this category, the 14-day right of withdrawal cannot be exercised simply because the Customer has changed their mind.
The exclusion from the right of withdrawal does not affect the statutory guarantee of conformity. If the sandals received are defective, do not conform to the characteristics ordered or are different from what was requested, the Customer retains the rights provided for under applicable law.
Any possibility of requesting a size exchange, product exchange or modification of made-to-order sandals is governed by the section Product Exchanges and Size Exchanges.
How to Request a Return
For products for which the right of withdrawal applies, the Customer may submit a request directly through their account.
1.Log in to My Account → Returns and Withdrawals, or use the button available on the order page.
2.Select the type of request (withdrawal, return or damaged item), choose the products concerned and indicate the reason.
3.You will receive an email confirmation containing the instructions and the address to which the products must be sent: Sandali Corcione, Corso Italia 288, 80067 Sorrento (NA), Italy.
4.The products must be shipped within 14 days from the date on which the withdrawal was communicated, carefully packed and in compliance with the conditions set out on this page.
Once the intention to exercise the right of withdrawal has been communicated, the products must be returned without undue delay and, in any event, within 14 days from the date on which the withdrawal was communicated, as provided for by Article 57 of the Consumer Code.
The products must be carefully packed and returned in compliance with the conditions set out on this page.
Return Shipping Costs
The direct costs of returning the products shall be borne by the Customer.
We recommend using a trackable shipping method and keeping the shipping receipt until the return procedure has been completed.
Conditions for Accepting a Return
For products subject to the right of withdrawal, the Customer must handle and keep the goods with due care.
Shoes may be inspected and tried on only to the extent necessary to establish their nature, characteristics and fit, in the same way as would normally be permitted in a physical store.
We therefore recommend trying on the footwear only indoors and on a clean surface.
The Customer is responsible for any reduction in the value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.
Products should therefore be returned:
• without signs of outdoor use and with soles free from marks, scratches or dirt resulting from use beyond a normal fitting;
• unmodified and unaltered;
• where possible, complete with the original box, protective bag, tags and any accessories received;
• carefully packed, preferably using additional outer packaging, without applying adhesive tape or labels directly to the original packaging.
The absence of or damage to the original packaging does not automatically result in the loss of the right of withdrawal, without prejudice to the Customer’s possible liability for any reduction in the value of the product in the cases provided for by law.
Refunds in the Event of Withdrawal
In the event of a valid exercise of the right of withdrawal, Sandali Corcione will refund the payments received in relation to the products concerned, including the cost of the initial standard delivery in the cases and within the limits provided for by applicable law.
Any additional costs resulting from the Customer’s choice of a delivery method other than the least expensive standard delivery option offered by Sandali Corcione will not be refunded.
The refund will be made within 14 days from the date on which Sandali Corcione is informed of the Customer’s decision to withdraw.
Sandali Corcione may, however, withhold the refund until the returned products have been received or until the Customer has provided evidence that the products have been sent back, whichever occurs first.
The refund will be made using the same means of payment used by the Customer for the original transaction, unless otherwise agreed and provided that the Customer does not incur any costs as a result of the refund.
The direct costs incurred by the Customer for returning the products remain the Customer’s responsibility, except where the return is due to a defective or non-conforming product or to an error attributable to Sandali Corcione.
Product Exchanges and Size Exchanges
In addition to the rights provided for by law, Sandali Corcione accepts requests for product exchanges or size exchanges, subject to the conditions set out in this section.
The request may be submitted through the procedure available in the Customer’s account, indicating the order number, the product purchased and the replacement product or size requested.
The possibility of carrying out an exchange is subject to the availability of the requested product or size.
The product returned for exchange must be intact and must not show signs of use beyond what is necessary to check its fit.
Unless the exchange is required due to an error by Sandali Corcione or because the product is defective or non-conforming, the cost of returning the product shall be borne by the Customer.
Any costs relating to the shipment of the replacement product will be charged to the Customer.
Exchanges for Made-to-Order Sandals
The exclusion from the right of withdrawal applicable to made-to-measure or clearly personalized sandals does not prevent Sandali Corcione, at its discretion and as an additional commercial service, from offering the possibility of requesting a size exchange, product exchange or modification.
The possibility of exchanging made-to-order sandals must be checked in advance with Sandali Corcione and will depend on the characteristics of the product and the modification requested.
This possibility does not constitute a right of withdrawal and does not entitle the Customer to a refund of the purchase price, except where the product is defective or non-conforming and the remedies provided for by the statutory guarantee apply.
Defective, Damaged or Non-Conforming Products
The right of withdrawal must not be confused with the rights available to consumers in the event of a defective or non-conforming product.
All products sold to consumers by Sandali Corcione, including made-to-measure or clearly personalized sandals, are covered by the statutory guarantee of conformity provided for by the Consumer Code.
If the Customer receives a product that is defective, damaged, does not conform to the characteristics ordered or is different from the product purchased, they are invited to promptly contact Sandali Corcione, indicating the order number and providing a description of the issue.
Photographs of the product may be requested in order to assist in assessing the reported issue.
Where a lack of conformity exists, the Customer may exercise the remedies provided for under applicable law.
The exclusion from the right of withdrawal applicable to made-to-measure or clearly personalized sandals does not limit or remove any rights arising from the statutory guarantee of conformity.
Variations Due to Handcrafted Production
Sandali Corcione sandals are handcrafted and individually made according to the Customer’s order.
For this reason, they may feature slight variations in workmanship, finishes, material shades or other details compared with the images displayed on the website.
Such variations, where they are inherent in handcrafted production and do not affect the essential characteristics, quality or conformity of the product with the order, do not necessarily constitute a lack of conformity.
The Customer retains the right to dispute any actual discrepancies compared with the characteristics agreed, declared or specifically requested at the time of the order.
Returns with Reduced Product Value
If a product returned under the right of withdrawal shows signs of use, damage or handling beyond what is necessary to establish its nature, characteristics and functioning, Sandali Corcione reserves the right to assess any reduction in the value of the product and to apply a corresponding reduction to the refund, within the limits permitted by applicable law.
The mere absence of or damage to the original packaging does not automatically result in the loss of the right of withdrawal.
